TERMS OF SERVICE

These Terms of Service govern your use of solopopbaseball.com and purchases from SOLOPOP Baseball, operated by Fifth Avenue Partners ("SOLOPOP," "we," "us," or "our"). By using this website or placing an order, you agree to these terms and our Privacy Policy.
1. ELIGIBILITY AND ACCOUNTS
You must be the age of majority in your province or territory to place an order, or have permission from a parent or legal guardian. You are responsible for providing complete, current, and accurate account, billing, shipping, and contact information.
2. PRODUCTS AND SAFE USE
Product descriptions, images, prices, and availability may change without notice. SOLOPOP products must be used only as directed. Use only approved lightweight perforated plastic training balls with the SOLOPOP Batting Trainer. Never use a regulation baseball or regulation softball. Use the product in a clear, controlled area, keep people and breakable objects away from the hitting path, and provide appropriate adult supervision for children. Stop using any damaged product.
3. ORDERS, PRICES, AND PAYMENT
All prices are in Canadian dollars unless stated otherwise. Taxes and shipping charges are calculated at checkout. Submitting an order is an offer to purchase; an order is accepted when we confirm it. We may reject or cancel an order because of inventory, payment, pricing, fraud-prevention, shipping, or other reasonable concerns. If we cancel a paid order, we will refund the amount charged for the cancelled item.
4. SHIPPING
We currently ship only within Canada and do not ship to the United States. Delivery estimates are not guarantees and can be affected by carriers, weather, address errors, or events outside our control. Review our Shipping Policy for current rates and delivery estimates.
5. REPLACEMENT GUARANTEE AND CANCELLATIONS
The SOLOPOP Batting Trainer includes a one-year replacement guarantee for manufacturing defects and breakage during normal use. Proof of purchase is required. The guarantee does not cover misuse, modification, improper storage, cosmetic wear, or use with regulation baseballs or softballs. Orders may be cancelled before fulfillment. 6. WEBSITE USE AND INTELLECTUAL PROPERTY
You may use this website only for lawful personal shopping and informational purposes. Website text, graphics, branding, photographs, and other content are owned by or licensed to SOLOPOP Baseball and may not be copied, republished, sold, or commercially exploited without written permission. SOLOPOP Baseball is not affiliated with or endorsed by Major League Baseball, the New York Yankees, or any professional baseball club.
7. THIRD-PARTY SERVICES
Our store is hosted by Shopify and may use third-party payment, analytics, shipping, and service providers. Their services may be governed by separate terms and privacy policies. Links to third-party websites are provided for convenience; we are not responsible for their content or practices.
8. DISCLAIMERS AND LIMITATION OF LIABILITY
Except for the express one-year replacement guarantee and rights that cannot legally be excluded, products and website services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, SOLOPOP Baseball and Fifth Avenue Partners are not liable for indirect, incidental, special, or consequential losses arising from use of the website or products. Nothing in these terms limits any non-waivable rights or remedies available under applicable Canadian consumer protection law.
9. GOVERNING LAW
These terms are governed by the laws of Ontario and the applicable federal laws of Canada. Any dispute will be handled in the courts with jurisdiction in Ontario, unless applicable consumer law requires otherwise.
